1. Acceptance of Terms

By accessing or using CashFlowSmart (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and Green Banana Enterprise ("Company," "we," "us," or "our").

2. Description of Service

CashFlowSmart is a financial management platform designed for general contractors. The Service enables users to upload bank transaction data, categorize expenses, track job margins, calculate cash flow projections, and receive AI-generated financial insights. The Service is provided on a subscription basis.

3. Eligibility

You must be at least 18 years of age and operating a legitimate business to use the Service. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@cashflowsmart.io if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.

5. Subscription and Payment

5.1 Subscription Plans

CashFlowSmart is offered on a monthly or annual subscription basis. Current pricing is displayed on the Pricing page. Prices are in US dollars and are subject to change with 30 days' notice.

5.2 Billing

Subscriptions are billed in advance on a recurring basis. Payment is processed by Stripe, Inc. By providing payment information, you authorize us to charge your payment method for all fees incurred.

5.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days at billing@cashflowsmart.io.

6. Your Data and Intellectual Property

6.1 Your Data

You retain full ownership of all financial data, project data, and other content you upload to the Service ("Your Data"). By uploading Your Data, you grant us a limited, non-exclusive license to process, store, and display Your Data solely for the purpose of providing the Service to you.

6.2 Our Intellectual Property

The Service, including its software, algorithms, user interface, and documentation, is owned by Green Banana Enterprise and protected by intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works from any part of the Service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, royalty-free license to use that feedback without any obligation to you.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload data that you do not have the right to use or that infringes third-party rights
• Attempt to gain unauthorized access to the Service or its underlying systems
• Introduce malware, viruses, or other harmful code
• Use the Service to process data on behalf of third parties without their consent
• Resell, sublicense, or provide access to the Service to third parties without our written consent

8. Financial Information Disclaimer

CashFlowSmart provides financial calculations and AI-generated insights based on the data you provide. This information is for informational purposes only and does not constitute financial, accounting, tax, or legal advice. The accuracy of all calculations depends entirely on the accuracy and completeness of the data you upload. Always verify important financial decisions with a qualified accountant or financial advisor. We are not liable for financial decisions made based on information provided by the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GREEN BANANA ENTERPRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Indemnification

You agree to indemnify and hold harmless Green Banana Enterprise, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason with 30 days' notice. Upon termination, your right to use the Service ceases immediately. We will provide you with an export of Your Data for 30 days following termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in Indianapolis, Indiana, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
